16 Apr Jail for Derry father who gave son drugs as a 21st birthday ‘present’
Derry Crown Court heard today how a local man gave his son “an unedifying present” for his 21st birthday present by organising him to get the drug Fentanyl.
Noel Lavy (41), of Clon Elagh in the Skeoge area of the city, was jailed after he admitted five drug charges.
Lavy admitted being concerned in the supply of Fentanyl on 9 November 2017.
He also admitted charges of being concerned in the supply of Oxycontin on 28 November and 3 December, 2017.
He also pleaded guilty to possessing Diazepam with intent to supply on 6 December as well as a charge of possessing Diazepam on 18 January last.
The court heard police attended an address in Clon Elagh and Lavy was present as was his son and another man.
The court was told subsequent inquiries and an examination of Lavy’s phone led police to conclude he was involved in the supply of drugs, primarily to his son.
Defence counsel, Eoghan Devlin, told the court Lavy had a dependency on drugs which had led to issues in his life.
Mr Devlin added this activity had brought him to “the attention of other parties in the community” and he had suffered from a paramilitary attack.
The barrister said Lavy “had done himself considerable damage through drugs.”
Passing sentence. Judge Gemma Loughran Lavy supplied drugs, primarily to his son, and said on the occasion of his son’s 21st birthday had supplied him with Fentanyl.
The judge said in a pre-sentence report, Lavy had expressed concerns about his son who was an addict but she added “this is the same son you supplied with drugs.”
Judge Loughran said there had been’ a proliferation of drug offences’ in the Derry area in recent times which was concerning as “drugs cause considerable harm.”
Lavy was sentenced to a total of 16 months in prison of which he will spend half in custody.
