Lynn man should serve prison time, pay for funeral costs after woman’s fatal overdose, prosecutors say

Federal prosecutors are seeking a prison term of up to 14 years for a Lynn drug dealer who supplied fentanyl to a 34-year-old mother the day after she got out of rehab, leading to her fatal overdose, records show.

The government also wants the dealer, Yeffry Reynoso, who first met the woman on the Backpage website and asked her to trade drugs for sex, to reimburse her relatives for funeral expenses they incurred when she was laid to rest, legal filings show.

The government’s recommended sentence for Reynoso, 27, was filed in a plea agreement Wednesday in US District Court in Boston, where Reynoso pleaded guilty to drug distribution charges in connection with the Melrose woman’s death in January 2017.

Under terms of the agreement, the government will recommend a prison term of nine to 14 years. Prosecutors also are seeking an order that Reynoso pay restitution of at least $4,765 to the family of the woman, identified in court records as K.H. She is survived by a daughter.

The payment, the agreement said, represents “the funeral expenses incurred by the family of K.H., who died of an overdose after ingesting drugs distributed by Defendant. … Defendant understands that an order of restitution will be entered without regard to Defendant’s ability to pay, that this order of restitution may not be discharged, in whole or in part, in any bankruptcy proceeding, and that restitution will be due and payable immediately (unless Defendant establishes to the court’s satisfaction that Defendant is unable to do so).”

Reynoso pleaded guilty Tuesday to one count of conspiring to distribute at least 100 grams of heroin and at least 40 grams of fentanyl in 2016 and 2017, and six counts of distributing heroin or fentanyl on various dates in 2017, according to US Attorney Andrew E. Lelling’s office.

Lelling’s office said Reynoso “admitted that he sold heroin and heroin mixed with fentanyl to” K.H. “after being told by her friend not to do so, and that the customer overdosed and died after using the drugs he provided.”

Reynoso’s sentencing is scheduled for May 9. He faces a maximum prison term of 40 years and a fine of up to $5 million, according to authorities.
