Despite a last-minute bid to withdraw his guilty plea and stand trial, Deposit man was sentenced Thursday to 15 years in state prison for two Broome County drug busts tied to meth and fentanyl. 

Marlon R. Graham, 37, pleaded guilty in Broome County Court to possessing methamphetamine in June 2018 in Kirkwood and, in November 2018, that he possessed fentanyl in Deposit. He admitted to felony counts of first-degree criminal possession of a controlled substance and second-degree criminal possession of a controlled substance.

Broome County Court Judge Kevin Dooley told Graham the amount of drugs he’d been caught with were “beyond light years” what might be considered for “personal use.”

Graham and co-defendant Johnnah DeGraw were arrested Nov. 30 after a raid revealed a collective 6-pound stash of drugs — heroin, fentanyl and meth — worth hundreds of thousands of dollars if sold on the street.

The drug bust revealed:

  • Heroin: More than two pounds; $100,000 to $250,000 estimated street value.
  • Methamphetamines: More than four pounds; $181,000 to $217,000 estimated street value.
  • Fentanyl: More than two pounds; $1 million estimated street value.

“You certainly are in the big time here, in terms of the level of drug dealing,” Dooley told Graham on Thursday, after denying Graham’s request to take his plea back based on a  potential evidence issue.

Separately, Graham and DeGraw are facing a federal drug trafficking indictment tied to the Deposit drug bust.

Six months before being charged in the Deposit drug trafficking case, Graham and DeGraw had also been arrested by the Broome County Special Investigations Unit Task Force after a June 8, 2018, raid in Kirkwood that netted $29,000 worth of crystal meth.

Investigators seized an estimated $29,000 worth of crystal meth and accused both suspects of working together to sell it around Broome County. 

On March 29, DeGraw was sentenced in Broome County Court to 12 years in prison.
