Milwaukee man arrested on drug and gun charges | Paywall

A 20-year-old Milwaukee man was arrested Tuesday night after police were called to a report of one man threatening another with a pistol in the drive-through lane of the Ashland Arby’s restaurant.

Rogelio Fuentez was arrested on preliminary charges of endangering safety while armed, carrying a concealed weapon, possession of fentanyl with intent to deliver and a variety of other charges. He is accused of pointing a Glock 9 millimeter handgun at the driver of a vehicle who honked at a car in which Fuentez was a passenger, according to police reports.

The driver of the car that honked sped off and called 911 to report the incident, as did a witness to the incident.

When officers arrived at the restaurant, they found the car Fuentez was in was still in line to receive food. They then made a high-risk traffic stop. In the vehicle along with Fuentez were a female driver and another male passenger.

“They got everybody out and one of the passengers got out of the car, started taking his shirt off and pulled his pants down to his ankles, saying ‘I’m not armed, I’m not armed,’” said Ashland Police Chief Jim Gregoire. Police then approached the man to handcuff him, but he pulled his pants up and began running around the restaurant. A foot chase ended when police rounded the building and found Fuentez face down, with his hands behind his back. He was then handcuffed and led to a police car. The handgun was found about 10 feet from where Fuentez was lying, police said.

The report said that as officers attempted to cuff him, Fuentez began to resist, spitting on officers, telling them they should get AIDS every time he spit.

“They got him into the squad car and he was kicking the doors and windows and whatnot, screaming at the officers,” Gregoire said.

Gregoire said when the three were ordered to get out of their car the other male passenger told police that Fuentez was “the one with the gun.”

The passenger and the female driver were held briefly but then released, Gregoire said.

Police searched the car and found a duffle bag with Fuentez’s name in it. In the bag and elsewhere in the car officers discovered methamphetamine laced with fentanyl, police said. They also found marijuana, two spent 9 millimeter shell cases and unexpended 9 millimeter rounds.

Ashland County Circuit Court Judge Kelly McKnight on Wednesday ordered Fuentez held on $2,500 cash bail.

Fuentez asked that the bail be lowered, but McKnight said considering the number and severity of the potential charges that he faced, combined with the fact that he had already been out on bail facing three felony charges at the time he was arrested, he was somewhat surprised that the bail asked for by the prosecution was as low as it was.

Fuentez faces an initial appearance in Ashland County Circuit court on Jan. 7 at 1 p.m.
