Second suspect charged in alleged Foxboro fentanyl mill | Local News

FOXBORO — Police responding to a domestic disturbance call in November 2017 discovered an alleged fentanyl mill and arrested a resident of the apartment, but a second man got away.

The man is believed to have jumped off the second-floor balcony of the apartment at the Lodge at Foxborough off Foxborough Boulevard and ran through woods toward Interstate 95, where police K-9s lost the scent.

The suspect, identified as Randy Guerrero, was arrested earlier this month at JFK International Airport in New York and was released over the objections of prosecutors on $300,000 bond with conditions, including GPS monitoring, after an initial appearance in U.S. District Court in Brooklyn.

Now authorities are looking for him again.

A warrant was issued for Guerrero, believed to be 27, after he failed to appear for his scheduled arraignment in U.S. District Court in Boston, according to a spokesperson for the U.S. Attorney’s office.

Guerrero faces charges of possession with intent to distribute 400 grams or more of fentanyl and aiding and abetting, according to court records.

If convicted, he faces a mandatory minimum sentence of 10 years in prison.

Scott Lauer, a federal public defender for Guerrero, said he had no comment on the case.

A second defendant, 25-year-old Stephen Pena, was arrested on Nov. 3, 2017 after scuffling with police who were trying to enter the apartment to investigate the domestic call.

Pena, who had no prior criminal record, was initially held in jail but was released on bond with GPS monitoring. An arrest warrant was issued for him after he failed to appear for a pretrial hearing in October 2018, a month after a judge denied his request to throw out evidence in the case, according to court records.

Both men are charged in connection with the discovery of 4 1/2 pounds of alleged fentanyl, a drug is 50 times more powerful than heroin, inside the apartment. Police also found large blue 55-gallon drums and other suspected drugs and paraphernalia, according to court records.

They are charged in a superseding indictment unsealed June 3, a day after Guerrero was arrested at JFK International Airport in New York allegedly attempting to leave the United States, according to court records.

A lawyer who represented him at the hearing did not respond to a call and email for comment.

In addition to the suspected fentanyl, police and agents with the Drug Enforcement Administration found alleged drug paraphernalia associated with narcotics distribution, according to court records.

In the kitchen, police found a large pan on the stove with a whitish substance in it and in the bathroom they say they discovered a yellowish-brown powder in small plastic bags and drug paraphernalia, according to court records.
