BARNSTABLE — A 35-year-old Buzzards Bay man was sentenced to seven to nine years in prison Friday after pleading guilty in Barnstable Superior Court in two drug trafficking cases, one of which stemmed from his arrest while out on bail.

In the first case, Frank Fagone pleaded guilty to trafficking in 18 to 36 grams of heroin; possession to distribute cocaine; subsequent offense; and two counts of conspiracy to violate the Controlled Substances Act.

Barnstable police conducted a monthslong investigation into Fagone and two other people, resulting in a search of a Hyannis motel room on April 19, 2017.

In the second case, which had been pending in Falmouth District Court, he pleaded guilty to trafficking more than 10 grams of fentanyl and conspiracy to violate the Controlled Substances Act.

In that case, officers working on the Cape Cod Drug Task Force stopped a vehicle March 28 driven by Fagone’s wife, Sherrie, while he was in the passenger seat. She was found to have a small bag of what police believe to be a combination of fentanyl and heroin, according to a police report.

Fagone was on pretrial release in the first case when he was arrested.

Cape and Islands Assistant District Attorney Jennifer Bright asked that Fagone be sentenced to eight to 10 years in prison followed by three years of supervised probation.

Fagone’s attorney, Franchesca Ferguson, said her client had a rough upbringing, marred by a mother addicted to heroin who eventually died from an overdose, and asked Judge Robert Rufo to impose a five- to six-year sentence followed by three years of probation.

“Respectfully, I looked at the case, I assessed his record, and seven to nine years at Cedar Junction is appropriate,” Rufo said.

Fagone’s record includes a six-year federal prison sentence after he pleaded guilty to distribution of heroin charges in 2006.

Rufo said he considered the input of probation officers who said Fagone does not comply with his pretrial conditions.
